Abstract

The aim of this work is to investigate on the role of the precautionary principle in the decision process of the public administration, in light of the ever rising relevance which the same is acquiring, in order to protect constitutionally guaranteed rights, such as the right to health and the one to the environment. The principle under examination, developed in an international setting, finds its legitimacy in some constitutional dispositions and it had its final consecration due to the national and European case law intervention and due to the legislator who inserted it among the dogma which regulate the administrative action.
