Brevi note sul "caso Siri". Revoca del Sottosegretario di Stato tra "incertezze" normative e impatto sulla forma di governo

Abstract

This paper aims to considerate the recent affair that invested the Government, and, in particular, the revocation of the Secretary of State at the Ministry of Infrastructure and Transport (on. A. Siri). The case study allows to attempt a reconstruction, in a historical-normative key of the institute, of problems connected to its constitutional basis. For this reason, throughout the history of the italian Republic, the political use of Secretary of State’s figure has prevailed over the more properly administrative one, typical of constitutional systems different from ours (British or French model). Thereby, it would be necessary to provide for a different appointment and revocation’s procedure of Secretary of State, in order to enhance the relationship of trust between the latter and the Ministers who are called upon to assist them.
